2013 Legal changes in Medical Benefits provided by your Auto Insurance:
Major changes are in store for Florida Automobile Driver's in 2013 as their
Personal Injury Protection (PIP) benefits will be greatly reduced and made more
difficult to access. As part of Florida's No-fault Automobile Insurance
Law, all drivers are required to carry $10,000 in Personal Injury
Protection to ensure your full and timely recovery from any injuries suffered in
a car accident. Beginning January 1, 2013, you will still be required to carry
$10,000 in PIP coverage, however, you're access to this coverage for your
medical needs will be significantly limited.
What You Need To Know:
-You must be examined
and begin treatment within 14 days of an auto accident or you will
completely lose access to all $10,000 worth of PIP benefits.
Previously, victims injured in an auto accident could use their PIP benefits for
necessary medical treatment for as long as 2 years following a car crash.
Going forward, it is imperative that those involved in automobile accidents
obtain an examination and auto accident injury screening within 2 weeks of the
accident to avoid losing their insurance benefits.
-The new law also limits PIP insurance coverage to only $2,500 for those who have not
been determined to have an "Emergency Medical Condition."
This can be a somewhat ambiguously defined term in medical
publications. Therefore, it is important that you seek the help of a
specialist trained in the examination of auto accident injuries within 14 days
of your accident to determine the extent of your injuries and ensure that you
are able to secure all of your available insurance benefits.
-If your Auto Insurance Carrier
denies coverage to you for either of the above reasons, you may still be
eligible for coverage of medically necessary treatment in our offices
through the use of a Letter of Protection if you are being represented by an
Attorney and are filing a claim for recovery against the at-fault
